PROCESSING OF PERSONAL DATA OF CONTRACTORS

INFORMATION CLAUSE ON THE PROCESSING OF PERSONAL DATA OF COUNTERPARTIES

In accordance with the obligation arising from Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (GDPR), we would like to inform you that:

1. The administrator of your personal data is MTA automatyka przemysłowa Sp. z o.o. Sp.k. with its registered office in Prochowice (registered office address and address for service: ul.Kolejowa 10, 59- 230 Prochowice), entered into the register of entrepreneurs of the District Court for Wrocław – Fabryczna IX Commercial Division of the National Court Register under KRS number 0000698433, NIP 6922515655, REGON 368471208, e-mail: tomasz.maruchniak@e-mta.pl

2. Your personal data will be processed for the purpose of establishing and performing a contract to which you are a party.

3. The legal basis for the processing of your personal data is Art. Article 6 (1) 1 lit. b) GDPR, which means that the processing is necessary for the performance of the contract to which you and MTA automatyka przemysłowa Sp. z o.o. are a party. Sp.k. with its registered office in Lubin.

4. The legal basis for the processing of your personal data may also be Art. Article 6 (1) 1 lit. f) GDPR, if the processing of personal data is necessary to achieve the purposes resulting from the legitimate interests of MTA automatyka przemysłowa Sp. z o.o. Sp.k. or a third party, such as direct marketing or the establishment, exercise or defense of claims.

5. Providing your personal data is voluntary, but necessary for the performance of the contract. Failure to provide data may result in the inability to conclude and perform a contract.

6. The recipients of your personal data may be entities providing e-mail hosting services, advisory service providers.

7. Due to the fact that the Administrator uses the services of other providers in the field of INFORMATION SOLUTIONS. The provision of personal data may be transferred outside the European Union. We assure you that in this case, the transfer of data will take place only to entities certified under the Privacy Shield (so-called " Privacy Shield) or on the basis of an appropriate agreement between the controller and that entity containing standard data protection clauses adopted by the European Commission.

8. Your personal data will be processed by MTA automatyka przemysłowa Sp. z o.o. Sp.k. for the duration of the contract, as well as later, i.e. until the expiry of the limitation period for any claims arising from the contract and in connection with the implementation of the 5-year archiving obligation regarding documents stored for tax purposes; data processed for the purpose of pursuing claims (e.g. in court proceedings) will be stored for the period of limitation of claims, resulting from the provisions of the Civil Code.

9. You have the right to:

– access to and obtain a copy of your data;

– rectification (correction) of its data;

– deletion of data, restriction of data processing;

– object to the processing of the data;

– data portability;

– lodge a complaint with the supervisory authority.

10. You have the right to lodge a complaint with the supervisory authority, which is the President of the Office for Personal Data Protection,

11. On the basis of the data provided by you, no automatic decision-making as well as profiling will be taken.

12. Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC, shall apply to matters not covered by this clause.
